Statement from Mr. R. Subramanian Managing Director, Subhiksha Trading Services Ltd.

We have been given to understand that FDA has finally after a period of 6 months passed a order on our appeals – while this was purely a departmental appeal – filed as a procedure required in law before invoking the courts - and nothing much was expected out of it in any case given the background and the way the FDA has dealt with this matter – the final order passed was still a shock for as it throws all accepted legal norms outof the window

We have been informed – we are yet to peruse the order in full – that the FDA Commissioner has quashed one of the 2 suspensions against our company – this was a case where FDA was not even sure when they had conducted the inspection.

Puzzlingly FDA has passed an order in the other appeal wherein they have held that the suspension against us be increased from 10 days to 20 days – we have also been informed that the orders of the Vendors who supply groceries has been cancelled – as we understand in a appeal the order can lawfully be either retained or modified to the benfit of the appellant and in this case the order is a unheard of process where in a appeal the punishments are increased against the appellant

As already known these vendor companies were not even given a show cause notice in the first place and they had a suspension and now this cancellation has been inflicted on their own appeal

It is quite obvious that the orders are not passed in normal course and seem to be done to please certain vested interests who have been attempting to sully our reputation. As everyone knows Subhiksha is in the forefront of the Bachat mera adhikar movement even more relevant in the high inflationary times. It is quite sad that the law can be abused so fragrantly and blatantly in this form. Given that the orders are so absurd and without doubt passed on considerations other than law and fact we shall be immediately approaching the High Court for remedy
